Terms and Conditions
Booking and Payment
A completed Booking Form, together with full course payment by electronic payment is required to secure a booking.
RYA Personal Log Book
All clients on practical courses beyond Competent Crew i.e. Day Skipper, must present a current RYA Yachtmaster Scheme Syllabus & Logbook G158 which complies with RYA practical course prerequisites.
Course Costs
The cost of your practical course covers the yacht, which is fully coded to the Maritime Coastguard Agency, Code of Practice and the Instructor. In addition all breakfasts, lunches, three evening meals on board, snacks, drinks (Teas/Coffees/Refreshments) are included as is all Yacht Fuel, Domestic Gas and Engine Hours usage. There are no extra charges for successful students to gain course completion certificates. Excluded are berthage/electricty charges, away from Largs Yacht Haven, paid collectively by students, hire of waterproofs, boots, sleeping bags and suggested reading materials. Classroom and Online Theory Courses include all required course materials, excluding a Bretton Plotter and Dividers. No extra charges for course completion certificates or examinations at the end of your course VHF SRC excepted. If an RYA Training Almanac was supplied it should be returned after software access has expired or at the end of the course prior to issue of a certificate.
Cancellation/Substitution
If you cancel your 1st Clyde Yacht Training course booking at least 30 days before the start of your course then a potential refund, 50% of your course fee, only if we can re-sell your place. If through unforeseen circumstances we have to cancel the course we will offer you alternative dates. Should these be unacceptable to you all monies received will be fully refunded to you. There will be no further liability on either party. The yacht(s) shown are usually used on our Practical Sail Training Courses but on occasion, subject to availability, we may require to substitute a different yacht for any Sailing Course at short notice.
Insurance
Yacht insurance does not cover you for accidents or loss or damage to personal effects unless caused by neglect of the Instructor. It is recommended that you have adequate insurance to cover medical, personal accident, and loss or damage to personal effects. 1st Clyde Yacht Training carries the usual marine insurance policy relating to collision and 3rd party liability limited to £3,000,000.
Fitness
All students should be fit enough to participate in operating a training yacht. It is strongly recommended that all those participating in the sport of Yacht Cruising should be able to swim 50m. It is essential the instructor in charge should know if any students are non-swimmers. If in doubt please discuss before booking. There is no upper age limit, but all students must satisfy themselves and a medical professional that they are fit and able to join their chosen course. Sailing is a physical pastime and students may be asked to undertake physically demanding work, as part of the course.
Health Declaration
In signing and submitting the booking form I declare to the best of my knowledge, I am not suffering from epilepsy, disability, giddy spells, asthma, diabetes, angina, or other heart condition and I am fit to participate in the sailing course. Please forward details of any medical treatment being received, which will be supplied to your Instructor.
Children
Children over thirteen are welcome if they are with an adult. It is an RYA requirement children under 16, other than for the 2 Day Weekend Courses or 5 Day Competent Crew Courses, may not become eligible for award of course completion certificates.
Complaint
Customer Care - We strive to make your training experience an enjoyable and happy one. If for any reason you experience a difficulty then please raise this immediately with your instructor. In the event that the difficulty continues then please raise this again at the end of your course with our Principal. Subsequently all complaints should be made by letter to 1st Clyde Yacht Training and then write to RYA Training Department at RYA House, Ensign Way, Hamble, Southampton SO31 4YA.
Safety
All safety equipment is provided. Students must ensure they don’t undertake any reckless action which could jeopardise the safety of your fellow students, instructor, any yacht or other vessel or endanger others. Students must observe high standards of personal conduct and not engage in any activity which could be considered offensive or annoying by a reasonable person. 1st Clyde Yacht Training reserves the right to terminate without warning, the course of any student engaging in any behaviour considered by the course instructor as offensive or dangerous. It is expressly a condition of course continuation that all students must comply with the instructions of the Course Instructor. Students may not use or be in possession of any illicit or illegal substances and may not bring alcohol on any vessel without the express consent of the instructor.
Lost Property
Regrettably no responsibility can be accepted for property left by course students.
Data Protection
Data Protection Act 1998. The above information including the questions as to your health and ability will be used by us to process your booking for the course and for attending to your safety whilst you are on one of our courses. We shall also include your name and address on our mailing list. If you do not wish to receive details of future courses and events please write to us. Names and addresses of candidates for RYA courses will be shared with the RYA for the purposes of registering your certificate. If you object please write to us. The data will not be shared with any third party for marketing or commercial purposes without first obtaining your explicit consent.
Online Terms & Conditions for Navathome courses only.
Online theory course booking is with Navathome.com.
The contract is between Navathome.com and the student.
Under Navathome.com and consumer contract regulations you have a statuary cooling off period of 14 business days from the day you receive your course. During this period you can cancel your purchase up to 14 days from the day of purchase. There will only be a full refund provided the package is unopened, undamaged and returned pack.
At any time during this period you can notify the training centre that you wish to cancel your contract with us and we will give a full refund including any delivery charges.
The course materials must be returned in an ‘as new’ condition and the postage paid.
If the course materials are being returned because they are faulty then the training centre will refund any postage costs.
Access to the online course material is terminated immediately.
You will not be able to claim a full refund if the course material has been damaged or if you have no proof of purchase.
The training centre reserves the right to deduct for the net cost of any missing or damaged course materials and postage.
Terms and Conditions.
Payments
Payments for course fees are due, in full, at the time of enrolment.
Payment can be made by bank transfer or by cheque in GBP, drawn on a UK bank.
In the case of payment by cheque we reserve the right to allow the cheque to clear before dispatching your student pack.
Once payment has been made and confirmed students will be sent the student pack and be supplied with the log in information to access the online course.
The student pack will be sent on the next working day and delivery to Europe is included in the course price.
Additional fees may be applied to addresses outside of these areas.
Navathome will not be held responsible for any duty or expenses incurred in the country of delivery.
Course expiry
There is an extendable access period of 6 months set for the course. An admin fee of £30 is charged for each time the course is extended.
If the access lapses it can still be extended anytime within a period of 3 years from the date the access period lapsed.
If a course remains dormant for more than 3 years, (has lapsed and not been extended within a period of three years) it will be terminated and the log in removed.
Once a student has passed the assessment their course is complete and their access terminated.
Internet access
Students must have access to the internet and email to complete the course.
Users
The course is not transferable and access is for the applicant only.
Compatability
Please check that the free trial runs on your device before booking.
The courses do not use a platform so work on most devices including Ipad, Iphone, PC, Mac, Android etc.
There some issues with the free chart plotter simulator provided by the RYA. It works on PC and Mac but not on mobile devices. It is not essential to the courses so can be worked around if a student does not have access the PC based units.
Pre course knowledge
Students should be at the correct level for the course being taken. No previous experience is required to take the Day Skipper theory course, Day skipper level theory is required for the Coastal/Yachtmaster theory and Coastal/Yachtmaster theory is required before taking the RYA Ocean theory.
What we provide
We will provide online back up and land line telephone backup as required by each student and every endeavor will be made to help students achieve their aims.
We will not disclose information about students unless we are legally obliged to do so or a student has agreed in writing in advance.
By enrolling you confirm that we may hold necessary business information about you including your name, address, course booking, payment and course record. No credit card information is held by Navathome.
Any contract between you and us shall be governed by English law and the courts of England and Wales shall have non-exclusive jurisdiction over any dispute.
All dealings, correspondence and contact between us and you shall be made or conducted in the English language.
Every effort has been made to ensure the accuracy of course information. However, we cannot accept any liability for errors, omissions or inaccuracies in the course content.
We continuously improve the course content and we do welcome any feedback from students which improve the quality of the course.
